When you submit an order or purchase request, you are making an offer to purchase the applicable product or service.

Biohacked AF reserves the right to accept, reject, limit, modify, or cancel an order where permitted by law.

An order is not considered accepted until payment has been successfully processed and we have confirmed the transaction.

Please review your order carefully before submitting it. We may be unable to accommodate cancellation or modification requests after an order has been accepted or fulfillment has begun.

If we reject, modify, or cancel an order, we will make reasonable efforts to notify you using the contact information provided at the time of purchase.

Purchases, cancellations, refunds, and exchanges are subject to our applicable Refund Policy and any additional terms disclosed at checkout.

Recurring Memberships or Subscriptions

Where a membership or subscription is offered on a recurring basis, the billing frequency, price, renewal terms, and applicable cancellation terms will be disclosed at or before checkout.

By purchasing a recurring membership or subscription, you authorize us or our applicable payment provider to charge your selected payment method at the stated recurring interval until the membership or subscription is canceled in accordance with the applicable cancellation terms.

You are responsible for canceling recurring subscriptions before the next billing date if you do not wish to renew.

Prices, discounts, promotions, and offers are subject to change without notice unless otherwise required by law.

Promotional offers may be subject to additional terms. If specific promotional terms conflict with these Terms, the promotional terms will govern with respect to that promotion.

You represent and warrant that:

  2. You are authorized to use the payment method provided;

  3. Charges incurred by you will be honored by your payment provider; and

  4. You will pay all applicable charges associated with your purchase.

SECTION 5 - SHIPPING AND DELIVERY

This section applies where Biohacked AF offers physical products.

All shipping and delivery times are estimates unless expressly stated otherwise.

We are not responsible for delays caused by shipping carriers, customs authorities, weather conditions, natural disasters, government actions, supply disruptions, or other circumstances outside our reasonable control.

Where permitted by applicable law, title and risk of loss for physical products pass to you when the products are transferred to the applicable shipping carrier.

SECTION 6 - INTELLECTUAL PROPERTY

The Services and their contents, including without limitation trademarks, trade names, logos, branding, text, articles, educational materials, course materials, research summaries, graphics, photographs, images, videos, audio recordings, downloadable materials, software, page layouts, designs, and other content, are owned by or licensed to Biohacked AF and are protected by applicable copyright, trademark, and other intellectual property laws.

The Services are provided primarily for your personal, non-commercial use.

Except as expressly permitted by these Terms or by Biohacked AF in writing, you may not reproduce, distribute, modify, sell, license, republish, publicly display, publicly perform, commercially exploit, or create derivative works from protected Biohacked AF content.

Nothing in these Terms grants you ownership of any intellectual property belonging to Biohacked AF, Shopify, our licensors, or any third party.

Biohacked AF's name, logos, product names, service names, designs, branding, and slogans are trademarks or other protected intellectual property of Biohacked AF or its licensors.

Shopify's name, logos, products, services, designs, and trademarks belong to Shopify or its applicable affiliates.

All other trademarks appearing through the Services belong to their respective owners.

Search Engine and AI Discovery Use

Nothing in this Section is intended to prohibit ordinary indexing, crawling, retrieval, summarization, citation, or linking by legitimate search engines, AI-powered search and discovery services, or other automated information-retrieval systems that access publicly available portions of the Services in accordance with our published technical access directives and applicable law.

Such access does not grant permission to reproduce, republish, sell, license, or commercially redistribute substantial portions of Biohacked AF's proprietary content except as otherwise permitted by law or expressly authorized by Biohacked AF.

Unless otherwise stated, we do not control or monitor these third-party services.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Biohacked AF is powered by Shopify, which provides technology that enables us to offer certain portions of the Services.

However, purchases made through Biohacked AF are transactions between you and Biohacked AF unless expressly stated otherwise.

Shopify is not the seller of Biohacked AF products, memberships, educational materials, or services and is not responsible for any aspect of transactions between you and Biohacked AF.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, or liabilities arising directly from your purchases or transactions with Biohacked AF.

You are solely responsible for the accuracy and legality of Feedback you submit.

  10. To bypass, circumvent, disable, or interfere with security, authentication, access-control, rate-limiting, or anti-abuse measures;

  12. To conduct bulk scraping, harvesting, extraction, or reproduction of proprietary content for unauthorized commercial exploitation;

Legitimate Automated Access

The restrictions above do not prohibit legitimate search engines, AI-powered search and discovery services, web crawlers, indexing services, research tools, or automated agents from accessing publicly available portions of the Services when they:

  1. Identify themselves through a recognizable user-agent or comparable technical means where reasonably practicable;

  2. Comply with our robots.txt file and other applicable published technical access controls;

  3. Do not bypass authentication, paywalls, CAPTCHAs, security mechanisms, or other access restrictions;

  4. Do not access private, restricted, account-only, or member-only content without authorization;

  5. Do not materially interfere with the performance or security of the Services; and

  6. Comply with applicable law.

We reserve the right to block, restrict, rate-limit, or otherwise manage automated access where reasonably necessary to protect the security, integrity, availability, intellectual property, or users of the Services.

Permission to crawl or index publicly available content does not constitute permission to commercially republish, redistribute, license, or create a substitute database containing substantial portions of Biohacked AF's protected content.

SECTION 14 - AUTOMATED AGENTS

For purposes of these Terms, an "Automated Agent" means software or a service that performs actions or interacts with digital services autonomously or semi-autonomously on behalf of a user or organization.

Automated Agents may interact with publicly available portions of the Services when their activity complies with Section 13 of these Terms and our applicable technical access controls.

  2. Circumvent CAPTCHAs, authentication mechanisms, paywalls, rate limits, or other technical safeguards;

  3. Misrepresent themselves as a human where identification as an automated system is reasonably required;

  4. Access private or member-only content without authorization;

  5. Conduct unauthorized transactions or account activity;

  6. Engage in abusive, deceptive, fraudulent, or unlawful conduct; or

  7. Continue accessing the Services after being specifically and lawfully instructed to stop.

We may limit or restrict Automated Agent activity where necessary to protect users, systems, proprietary content, or the operation of the Services.

Biohacked AF provides educational and informational content concerning topics that may include health optimization, longevity, fitness, recovery, body composition, performance, nutrition, scientific research, peptides, research compounds, and related subjects.

All such content is provided solely for general educational and informational purposes.

Biohacked AF does not provide medical advice, diagnosis, treatment, prescribing services, or individualized healthcare recommendations through the Services unless expressly stated otherwise and provided by an appropriately licensed professional acting within the scope of their professional practice.

Nothing contained on the Services should be interpreted as:

  1. Medical advice;

  2. A diagnosis or treatment recommendation;

  3. A recommendation to begin, discontinue, or modify any medication, supplement, therapy, or healthcare treatment;

  4. A recommendation to purchase, possess, administer, dose, or personally use any research compound; or

References to peptides, research compounds, experimental substances, emerging therapies, biological mechanisms, or scientific studies are presented for educational and research discussion.

THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF SAVINGS, LOSS OF DATA, BUSINESS INTERRUPTION, REPLACEMENT COSTS, OR SIMILAR DAMAGES, WHETHER ARISING IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

SECTION 19 - INDEMNIFICATION
